In the State Department's own passport material, the distinction between a U.S. citizen and a non-citizen national still exists. But it is mentioned only once, without explanation, buried among pages of instructions and boilerplate
It is not defined, not elaborated on, and not mentioned again.

Legally, this status is real and recognized.
8 USC § 1101(a)(21) defines a national as someone who owes permanent allegiance to the United States.
8 USC § 1408 outlines who qualifies as a non-citizen national—including those born in certain U.S. territories.
These individuals can lawfully obtain U.S. passports—without being citizens.
But the passport system is structured so that nearly everyone defaults to the citizen box—because that’s all they’re shown.
The status remains in law.
But no longer in the public mind.

Why it matters
Non-citizen nationals are not the same as citizens.
They are not bound by all the same jurisdictional presumptions.
They are not automatically subject to federal income tax, military draft, or certain federal mandates—unless they volunteer through contract.
So why is this status still mentioned—but never explained?
Because it's not a glitch.
It’s a design.
The law still recognizes it. The public doesn’t.
That’s the power of silence.

When applying, be prepared to explain it, not only with code, but with kindness and tenderness. The officers, more often than not , want to help you . They are just terribly uninformed.
